John Bolton warns Republicans . . . dump Trump now or lose big time

During an appearance on “CNN This Morning,” former Donald Trump national security adviser John Bolton warned Republicans that they need to rid themselves of his former boss after his comments about “terminating” the Constitution or they will pay a price for it later.

Speaking with co-hosts Don Lemon, Poppy Harlow and Kaitlan Collins, Bolton also reiterated his plans to run for the Republican party nomination in 2024 if only to disrupt the former president’s plans.

As Bolton explained, Trump’s comment last Saturday on Truth Social that “A Massive Fraud of this type and magnitude allows for the termination of all rules, regulations, and articles, even those found in the Constitution. Our great “Founders” did not want, and would not condone, False & Fraudulent Elections!” is nothing less than a “time bomb” waiting to go off during the next election.

Asked, “Do you think it should be disqualifying for a presidential candidate if they made comments like this?” Bolton shot back, “Well, of course it is disqualifying!”

“You know, the president takes an oath of office prescribed by the constitution itself that says he will to the best of his ability preserve, protect and defend the constitution,” he continued. “Trump himself took that oath. and effectively he’s now saying he didn’t mean it. and if God, forbid, he were ever elected and took the oath again, we couldn’t trust he would abide by those words.”

“I think this is existential,” he elaborated. “And even beyond being a matter of high principle, which i think it is, as a matter of practical politics, that statement even as he failed to try and correct it over the weekend, that statement is a time bomb sitting on the desk of every Republican member of the House and the Senate, every Republican candidate around the country.”

He then warned, “If we don’t very clearly, very soon, unequivocally reject it, naming Trump by name, this will come back to haunt us in November of 2024 in ways we can only imagine.”

TRUMP CALLS FOR THE U.S. CONSTITUTION TO BE “TERMINATED”

If this is not treason, then, there is no such thing as treason.

Former President Donald Trump on Saturday flat-out called for the “termination” of the United States Constitution so that he could be returned to the presidency.

Reacting to the news that Twitter in the runup to the 2020 election removed tweets that featured pornographic photos of Hunter Biden, Trump declared that the entire election had been stolen from him and demanded to be returned to the presidency.

“So, with the revelation of MASSIVE & WIDESPREAD FRAUD & DECEPTION in working closely with Big Tech Companies, the DNC, & the Democrat Party, do you throw the Presidential Election Results of 2020 OUT and declare the RIGHTFUL WINNER, or do you have a NEW ELECTION?” Trump wrote on his Truth Social platform. “A Massive Fraud of this type and magnitude allows for the termination of all rules, regulations, and articles, even those found in the Constitution. Our great ‘Founders’ did not want, and would not condone, False & Fraudulent Elections!”

This is not the first time Trump has called for his reinstatement as president, although this is the first time he has acknowledged that doing so would require the United States to shred its own Constitution on his behalf.

New York Times reporter Peter Baker wrote on Twitter that this seems like a dangerous new milestone for Trump.

“Needless to say, can’t think of a time in the United States when a former president (and would-be future president) has called for suspending the Constitution to let him seize power,” he wrote. “Even after all the shocks of the last few years, this one is remarkable.”

Besieged former President Donald Trump spent Tuesday morning firing off missives on his Truth Social account, lashing out in multiple directions over the loss by Kari Lake in Arizona and a general unhappiness with coverage of his meeting with a notorious anti-Semite.

The former president, who is being harshly criticized for consorting with Holocaust-denier Nick Fuentes, and who is also awaiting what is expected to be a rebuke for the 11th Circuit Court of Appeals over his attempt to avoid being investigated for stealing government documents and hiding them at Mar-a-Lago, also launched a diatribe about mail-in voting.

In one post on Truth Social, he raged, “RINO Karl Rove, a man with a losing record the likes of which few political operatives would be able to get away with, including his loss to me in 2016, fights so hard and so stupidly, but is constantly on Fox News and the once great Wall Street Journal, explaining how things should be done – and he doesn’t have a clue. People can’t stand him, a clone of even more unpopular Paul Ryan, who sadly runs Fox News, now on a very bad path. Rove is a DINIER (sic) of DINIERS (sic), which makes him a fool. WATCH!”

Changing directions, he then wrote, “Our Elections are Rigged. Mail-In Ballots are a total SCAM. How about all of those ‘BROKEN’ Republican Voting Machine? GET SMART REPUBLICANS, OR YOU WON’T HAVE A PARTY (OR COUNTRY) LEFT!” accompanied by a link to election deniers complaining about the certification of votes in Maricopa County where Republican Kari Lake went down to defeat.

Taking up mail-in ballots, he warned, “REMEMBER, YOU CAN NEVER HAVE FAIR & FREE ELECTIONS WITH MAIL-IN BALLOTS – NEVER, NEVER, NEVER. WON’T AND CAN’T HAPPEN!!!”

He then fell back on complaining about his presidential election loss to Joe Biden two years ago, with the former president writing, “I was 232-22 in the MIDTERM ELECTIONS, and still have to listen to DEMS, RINOS, and the Fake News explain how poorly I did (Also, 98.6% in Republican Nomination Endorsements!). Without my Endorsement of Republican Candidates, the numbers would have been a disaster. Same for 2018 and the CORRUPT ELECTION OF 2020, where almost everyone won because, and with the help of, ME – EXCEPT ME – and that’s because the Presidential Election was RIGGED & STOLEN!”

Trump’s crazytown supporters driving away moderate Republican and independent voters

During an appearance on MSNBC’s “Morning Joe,” former Sen. Claire McCaskill (D-MO) suggested that the failure of gubernatorial candidate Kari Lake to pull out a win in conservative Arizona is directly tied to election-deniers fostered by Donald Trump and adopted by Lake as her base.

Asked by co-host Jonathan Lemire what transpired in Arizona where a wide slate of far-right candidates went down to defeat, McCaskill said moderate voters are fed up with the craziness.

Asked if Lake is “…this the flavor of the month that goes away or is she going to be a voice we have to hear from in the Republican Party,” McCaskill quipped, “I think she should give Sarah Palin a call because she reminds me in many ways of Sarah Palin, and that didn’t work out so well for Sarah Palin over the long run.”

“I think that what happened in Arizona is a really good example of voters getting worn out by the bombastic craziness that is represented by the likes of Kari Lake,” she continued.

“Every time we play clips of those people testifying in front of that election board, every time we play clips from crazytown, that chases moderate voters into the arms of the Democratic Party,” she suggested. “A lot of those moderate voters were willing to take a chance on Donald Trump because he was different, and everybody wants change always, but now it is just wearing folks out, especially those moderate voters who are capable of voting for either party.”

“That’s what’s going on,” she asserted. “Now people like [Georgia Gov Brian] Kemp and [New Hampshire Gov. Chris] Sununu and [Florida Gov. Ron] DeSantis, they’re managing to keep a lot of those independent moderate voters in their camp, but not the crazy election deniers that are all about a toxic mix of guns and outrage, and grievance.”

In the new Congress, Hakeem Jeffries will lead while Kevin McCarthy and the GOP will make asses of themselves

The contrast between the man likely to be the next House speaker, Rep. Kevin McCarthy (R-Calif.), and the likely House minority leader, Rep. Hakeem Jeffries (D-N.Y.), could not be greater. Nor could the contrast be more indicative of the current state of the parties.

McCarthy remains hostage to the Christian nationalist base and the MAGA members who prioritize conflict with the Biden administration over governance. Jeffries, on the other hand, has broad appeal in his party and displays maturity and focus.

Appearing on CNN’s “State of the Union” on Sunday, Jeffries showed the discipline and generosity of spirit that no doubt pleased his predecessor, House Speaker Nancy Pelosi (D-Calif.). The key to her leadership, as it will be for Jeffries, is the ability to maintain unity in search of legislative deals and provide a contrast between a party that fights for working people and one that opposes reality and democratic governance.

Asked about conflict between moderate and left-leaning members, Jeffries refused to accept the “Democrats in disarray” framing. He responded:

The majesty of the House Democratic Caucus is that we are so incredibly diverse, in terms of race, and gender, and religion, and sexual orientation, region, life experience, and even ideology, from the left, to progressives, New Dems, Blue Dogs, moderate and centrist Democrats, all points in between. The thing about us, Jake, is that, while we can have some noisy conversations at times about how we can make progress for the American people … though people have doubted us, tried to create this frame of Democrats in disarray, we always are consistently able to come together, find the highest common denominator, get things done for everyday Americans, and make progress.

Trump’s hand-picked judge is about to be slapped down by the 11th Circuit

Judge “Loose” Cannon who was installed and hand-picked by Trump to approve his suit against the DOJ is about to have her rulings overturned b y the 11th Circuit — everything she did for Trump will be wiped out and he will be hauled before a DC federal jury.

Trump’s Problems Going for Bad to Worse — to Really, Really Bad

Writing for the Daily Beast, Epner predicted a ruling from the three judges involved — two of whom were appointed by the former president — could come before the end of the week and could quickly thrust the former president before his “greatest nightmare”: a Washington D.C. jury.

Based upon the questioning of the judges last week where Trump’s legal team faced a brutal grilling, the legal analyst suggested the case would be stripped from the Trump-appointed Cannon, who has been accused of running interference for the man who appointed her to a lifetime position on the bench.

“I rarely make predictions on court rulings. This is the exception,” Epner wrote. “I would be shocked if the 11th Circuit does not overturn Judge Cannon’s order. I also think it will happen quickly. The judges have asked for the upcoming schedule in front of the Special Master.”

“Special Master Dearie is required to issue his report and recommendation to Judge Cannon by December 16. After that, the parties would have the opportunity to object to Judge Cannon and, if necessary, the 11th Circuit,” he added. “That process would take months to play out. I cannot imagine the 11th Circuit allowing this circus to continue until Dec. 1, and that’s part of why I expect that the 11th Circuit will promptly overrule Judge Cannon, ending the entire process.”

As for what comes after, the legal analyst speculated Trump’s lawyers would quickly run to the Supreme Court for relief and will be promptly rebuffed.

“As soon as that happens, I expect that newly appointed Special Counsel Jack Smith and his team will indict former President Trump on multiple counts,” he wrote. “I expect that the indictment would be issued from the District Court for the District of Columbia. The crimes related to the removal and retention of national security documents in violation of the Espionage Act were arguably committed when Trump removed them from the White House, making D.C. a possible venue for an indictment on those charges.”

As an aside, he noted, “Trump would almost certainly fear a trial in front of a Washington, D.C., jury even more than he would fear a trial in front of a South Florida jury. Trump received only 5 percent of the vote in the District in 2020, by far his lowest total anywhere. By contrast, he won Florida in 2020.”

Legal experts predict the 11th Circuit will slap down Judge Cannon’s ruling and turn Trump over to a DC grand jury and the DOJ Special Prosecutor
Legal experts predicted that the 11th Circuit Court of Appeals will soon shut down the special master process in the Mar-a-Lago probe that was ordered by U.S. District Judge Aileen Cannon.

The special master process ordered by Cannon, a Trump appointee, effectively allows former President Donald Trump to challenge the search warrant at his office and residence before he is indicted — an extremely rare opportunity for a criminal defendant.

The oral argument by prosecutors, who are now under the direction of the newly appointed Special Counsel Jack Smith, shows that the 11th Circuit may be close to reversing Cannon’s process. The three judges on the panel — two of whom are Trump appointees — shared their skepticism that Cannon had jurisdiction to take action before an indictment, and that even if she did, she had no factual predicate to appoint a special master.

Judge Britt Grant, who was appointed by Trump, asked the former president’s legal team whether they tried to appeal Cannon’s finding that the Justice Department did not demonstrate a “callous disregard” for Trump’s rights. Trump’s attorney, James Trusty, said that they did not appeal the finding and Grant responded that the finding required a reversal of Cannon’s order.

Judge Andrew Basher also confronted Trump’s attorneys with two questions that stumped them: whether there was any precedent to prevent the DOJ from using the seized materials in its investigation before any indictments and whether there is any reason that Trump should be treated differently in the case than other defendants other than his status as the former president.

Trump’s attorneys were unable to give a satisfactory answer to the judges. After hearing the oral argument Trusty tried to keep the special master appointment by disparaging Cannon’s injunction against the DOJ. He argued that the DOJ was not harmed by the injunction because of an order issued by the 11th Circuit that allowed the department to use the 100 documents that were originally labeled “classified” in the investigation.

“Then, in language that I have never heard an attorney use in the more than 25 years I have worked as an attorney in criminal law, Mr. Trusty said that the injunction was ‘overblown’ and that what really mattered was preserving the Special Master,” wrote former federal prosecutor Mitchell Epner for The Daily Beast.

“The 11th Circuit judges and the DOJ attorneys jumped on that statement, noting that it was unprecedented for the DOJ to be barred by the judiciary from using documents seized by search warrant during their investigation,” said Epner.

Epner added in his analysis that he rarely makes predictions on court rulings, but “this is the exception.”

“I would be shocked if the 11th Circuit does not overturn Judge Cannon’s order,” Epner wrote, “I also think it will happen quickly. The judges have asked for the upcoming schedule in front of the Special Master.”

Special Master Raymond Dearie has scheduled the next hearing for Dec. 1, when he is expected to hear arguments about the remaining 900 documents in the investigation. On Dec. 16, Dearie would be required to give his report and recommendations to Cannon, and the parties will then have the ability to object to Cannon or the 11th Circuit. This process would likely last months.

“I cannot imagine the 11th Circuit allowing this circus to continue until Dec. 1, and that’s part of why I expect that the 11th Circuit will promptly overrule Judge Cannon, ending the entire process,” Epner predicted.

Former federal prosecutor Cynthia Alksne on Saturday also said that she expects the 11th Circuit to come down on Cannon for her protection of Trump. Speaking with MSNBC’s Ali Velshi, Alksne said that Cannon can expect to be reprimanded soon.

“It sounds like after reading the transcript of the appellate hearing in the 11th Circuit that they are going to get rid of the special master and they are going to slam this federal judge [Cannon] who put a wrinkle in the process that was totally unnecessary,” she said.

“And that will speed up the process and allow the government to really dive into those documents because, remember, it is not only — when you look at this case to a prosecutor — it is not just does he have the documents, where they willfully maintained and did he not return them when he was asked to. You also have to have sort of a global outlook on it like, why did he do it?” she elaborated.

“In order to do the prosecution, you kind of want to know that,” she added. “Is it an ego thing, as somebody leaked from the Justice Department or did those documents make it into the stream of his financial considerations? Is that why he ended up with these deals in the Middle East? Has Jared Kushner seen the documents? Who has touched them, who has seen them, who knows about them, who has used them?”

“The sooner we get rid of the special master process, or we complete it, the sooner we can get to that point and we can move forward with the prosecution,” Alksne stated.

If the 11th Circuit does rule against the former president, there will likely be an emergency appeal to the Supreme Court which will be denied almost immediately, according to Epner. The former U.S. attorney predicted that Smith and his team will then quickly move in to indict Trump on multiple counts. Despite Trump’s attempts to keep the case in the Southern District of Florida, the indictment will likely be issued from the District Court for the District of Columbia due to the removal of national security documents from the White House.

Trump’s worst fears will be realized if the trial happens in D.C. where he received only 5 percent of the vote in 2020, the lowest total in the entire country, Epner wrote.

The indictment may also go beyond the Espionage Act to include a felony charge relating to Trump’s demands that the IRS conduct audits of his political enemies. “I would not be surprised if each of those IRS employees cooperated with the DOJ, with all fingers pointing in Trump’s direction,” Epner said.

“The nice thing about prosecuting tax crimes is that the crimes are very clearly delineated. Few jurors have any sympathy for people who cheat on their taxes or wrongfully sic the IRS on an individual to carry out a personal vendetta,” Epner concluded.

GOP House majority will not work — “Welcome to Hell,” Kevin McCarthy

On Monday, POLITICO reported that House Democrats are adopting a “welcome to hell” attitude toward the incoming razor-thing Republican majority — and, after two years of struggling to hold together a narrow majority themselves, are eager to watch House Minority Leader Kevin McCarthy (R-CA), the favorite to be tapped Speaker, fight to do the same against bitter internal party disagreements.

“House Minority Leader Kevin McCarthy and his team are set to take over in January with the kind of margins that vexed Speaker Nancy Pelosi, but lacking the two decades of experience she brought to the task,” reported Sarah Ferris. “And the House GOP will have to steer legislation through with as few as four votes to spare while its leaders deal with an emboldened Freedom Caucus, internal finger-pointing over a disappointing midterm cycle, and a looming brawl over a 2024 presidential primary that features Donald Trump back in the mix.”

The report went on to describe McCarthy’s challenges as a “24/7 obstacle course for House Republicans who are already facing big questions about their agenda next year, from abortion policy to Ukraine aid to impeaching President Joe Biden and some Cabinet members.”

Indeed, one of McCarthy’s first challenges is going to be wrangling up the votes to be elected Speaker in the first place, something some hardline members of the GOP caucus have vowed to prevent.

“I don’t lie awake at night worrying about the bad legislation they are going to pass,” Don Beyer (D-VA) told POLITICO simply, “Because I don’t think they’re going to pass it.”

Fellow Virginian Gerry Connolly agreed, adding, “Paul Ryan and John Boehner both had a bigger majority, and they couldn’t exercise control.”
